Terms and Conditions for Aurum Essence Cosmetics xPaige

Introduction

These Terms and Conditions govern the use of services and products provided by Aurum Essence Cosmetics xPaige (“Consultant,” “Seller,” “we,” or “us”). By engaging our consulting services or purchasing products from our store, you (“Client,” “Customer,” or “you”) agree to be bound by the terms below.

1. Services and Products Provided

We provide the following:
- Consulting Services: Custom formulation of cosmetic products; product development and ingredient selection guidance; regulatory and compliance support; product testing and quality assurance guidance; branding and marketing consultation.
- Retail Products: Hair oils, beard oils, sprays, and other cosmetic products offered for direct sale on our website.

2. Client and Customer Responsibilities

- Consulting Clients must provide accurate and complete information, collaborate in a timely manner, and comply with all applicable cosmetic regulations.
- Retail Customers must provide accurate shipping details, review product ingredients, and use products only as intended.

3. Fees and Payment

- Consulting Services: Fees will be outlined in a separate invoice or proposal. Payment terms cover formulation costs, materials, labor, and samples. Payments delayed more than 7 days may incur a $50/day administrative fee unless prior arrangements are communicated and made.
- Retail Purchases: Payment is due at checkout. We accept common payment methods as listed on our store. All prices are subject to change without prior notice. Taxes are calculated at checkout where applicable.

4. Shipping & Delivery

- Domestic Shipping: Orders are processed and shipped within the timelines stated on product pages. Delivery estimates are provided for convenience but are not guaranteed.
- International Shipping: We ship internationally to select regions. Shipping costs are calculated at checkout or as listed in the product description. Delivery times vary by destination.
- Customs & Duties: International customers are responsible for all customs duties, import taxes, or fees imposed by their country. These charges are not included in the purchase price or shipping fee.
- Risk of Loss: Once an order is handed to the carrier, we are not liable for delays, loss, or damage during transit.

5. Returns, Refunds & Replacements

- Consulting Services: Refunds are not issued once work has begun. Cancellation policies and fees are outlined in client invoices.
- Retail Products: Returns, refunds, and replacements are governed by our official Replacement/Refund Form, which sets forth the applicable conditions. In general, custom formulations and opened products cannot be returned.

6. Confidentiality

The Consultant will maintain confidentiality of all proprietary information provided by clients. Clients may not disclose proprietary methods or formulations developed by the Consultant without prior written consent.

7. Intellectual Property

- Consulting: Formulations and concepts remain the property of the Consultant until full payment is received. Upon payment, rights to finalized formulations transfer to the Client, excluding proprietary methods or preliminary concepts.
- Retail Products: All branding, website content, and product designs remain the property of Aurum Essence Cosmetics xPaige and may not be reproduced or distributed without written consent.

8. Product Use & Liability Disclaimer

- All retail products are intended for external use only.
- Customers are responsible for reviewing ingredient lists and checking for potential allergies or sensitivities.
- Aurum Essence Cosmetics xPaige is not liable for misuse or adverse reactions, except in cases of gross negligence or willful misconduct.

9. Limitation of Liability

We will not be liable for damages or losses arising from the use of products or services except in cases of gross negligence or willful misconduct.

10. Amendments and Revisions

- Consulting: Minor formulation revisions within 7 days are included; major changes or requests outside the original agreement may incur additional fees. Minor and major revisions are defined at our discretion.
- Retail: We reserve the right to update product offerings, prices, or terms without prior notice.

11. Termination

- Consulting: Either party may terminate at any time. The Client must pay for all services rendered up to the termination date. No refunds will be issued for materials already purchased.
- Retail: Retail purchase agreements end once orders are fulfilled and shipped.

12. Governing Law

These Terms and Conditions are governed by the laws of the State of Maryland. Any legal action shall be brought exclusively in the courts of Prince George’s County, Maryland.

13. Dispute Resolution

Both parties agree to attempt mediation before pursuing any formal legal action.

14. Miscellaneous

This agreement constitutes the entire understanding between Aurum Essence Cosmetics xPaige and its Clients/Customers. Additional terms must be agreed upon in writing.
